A Portadown man threatened his brother in a row over land, a court has heard.
Mark Robinson (48), of Corcullentragh Road, appeared before Craigavon Magistrates’ Court on Friday, charged with breach of a restraining order as a result.
The court heard on April 9, police attended a report of an incident in the Portadown area.
They spoke to the reporting party, who alleged the defendant – his brother – had come to his address and an argument had taken place.
He said the defendant had driven his van “aggressively” towards him and made threats, including: “I’ll knock your f**k in.”
The reporting person stated he could smell alcohol from Robinson, whom he had a restraining order against.
The defendant was arrested and at interview denied the allegations.
A defence lawyer explained that the two parties are brothers and the exchange arose over a dispute regarding a common area of land.
She added that the breach occurred when the restraining order was “in its infancy” and the defendant wants to “move forward” past the incident.
District Judge Ranaghan commented: “Any breach of a court order is very serious.
“I’m told about the effect the whole thing is having on your mother, so it needs to stop.”
While recognising the custody threshold had been passed in the case, Judge Ranaghan opted to deal with the offence by way of a combination order.
Robinson was sentenced to 12 months of probation supervision and 50 hours of community service.
He was warned that if he breached the order, he would receive a four month prison sentence.
