A Richhill man who spat at a police constable following a domestic incident involving his brother has been fined £240.
The 38-year-old’s solicitor told court “This was an unfortunate incident, a simple matter in which he had too much to drink. Alistar would not be a heavy drinker and it would take too much to have an effect.”
Alistar MacGillivary, 38, of Tandragee Street, pleaded guilty to criminal damage, assault on police and common assault at Armagh Magistrates’, sitting at Newry, on Tuesday appearing via videolink from his solicitor’s office.
Prosecution outlined that on July 15, at around 6pm, police received a report of a domestic incident at an address on Tandragee Street in Richhill.
It was reported that the defendant had been verbally abusive to his brother, before lifting a plant pot and throwing it into a neighbour’s garden causing it to smash.
MacGillivary then entered the property, where he continued to be verbally abusive and refused to leave.
Upon the arrival of police, the defendant spat at one constable and had to be taken to the ground.
MacGillivary was cautioned, making no reply, but did make full admissions to the offences during at interview at Musgrave.
Defence solicitor Joseph Rafferty stated: “This was an unfortunate incident, a simple matter in which he had too much to drink. Alistar would not be a heavy drinker and it would take too much to have an effect.
“This incident has affected his mental health and stress. He is embarrassed by the dishonour which he has brought on his mummy and daddy.”
District Judge Eamonn King commented: “He does not have a serious record and this was a plea at the first opportunity and for that he will be given maximum credit.”
MacGillivary was ordered to pay a fine of £240, along with the offender’s levy of £15, within eight weeks.
