An Armagh man accused of breaching a non-molestation order by using a fellow prisoner’s phone whilst in custody has been refused bail.
Court heard the 23-year-old had spent between six and seven months in custody on remand for this along with other offences.
Patrick McCann, of St Patrick’s Park, appeared charged with four counts of breaching a non-molestation order, threats to kill and attempted harassment at the city’s Magistrates’, via videolink from Maghaberry.
It was heard that two of the breaches were alleged to have occurred whilst the defendant was in custody.
McCann was accused of using a fellow prisoner’s phone in order to contact the injured party.
The case was listed for a bail application with the prosecution stating this was objected to.
Defence barrister Scott McWhinney said: “Mr McCann has spent some time on remand for this and other pending matters, this we respectively submit would be time served or very close to this.
“He has spent six or seven months in custody and is not to be sentenced for these other matters until September 9, which is another couple of weeks away”.
District Judge Paul Copeland stated: “Court is concerned that you have previously breached bail, High Court bail at that, it is concerned about repeat offending and about putting the complainant at risk”.
Bail was refused the case was adjourned until September 9 for attitude to be entered.
