District Judge dismisses claims man failed to complete probation due to caring for wife

A man who blamed his inability to complete a community service order on his duty of care to his wife has been sentenced to three months in prison.

Iuri Jorge Louriera, of Saintfield Road, Belfast, pleaded guilty to two counts of breach a community service order at Craigavon Magistrates’ Court on Friday.

Court heard the defendant, originally from Portugal, had been sentenced to 150 hours of community service and 12 months’ probation in June of this year.

District Judge Bernie Kelly stated: “I told you that if you did not cooperate with probation and they brought you back to court that I would replace this order with a period of immediate custody.”

Louriera, through an interpreter, explained: “My wife had a caesarean section and has been unable to leave her bed, I have had to look after her.”

District Judge Kelly replied: “Are you aware of what gender I am and what that means I am likely to have gone through?”

She added: “I am sorry but a C-section does not have that sort of effect on a woman.”

Louriera was sentenced to three months in prison for both offences.
