A Keady man who assaulted a male leaving him with a broken nose and a chipped tooth has been ordered to complete a period of community service and probation.
The 51-year-old’s barrister told court: “There had been a family situation where he had taken matters into his own hands. He shouldn’t have done it and he is very remorseful for it.”
Edward Patrick Dynes, of Granemore Park, appeared for sentencing on assault occasioning actual bodily harm at Armagh Magistrates’ Court, sitting at Newry, on Tuesday.
Prosecution outlined that on November 2, 2020, at 2.45pm police received a report of an assault in the vicinity of Victoria Street in Keady.
It was alleged that the defendant had assaulted a male, punching him to the nose before a flurry of strikes, after Dynes had opened the injured party’s car door.
The injured party was left with a broken nose, requiring several hospital visits, and a chipped tooth.
Dynes was arrested and during interview he admitted the assault but claimed that certain facts were not accurate.
Defence barrister Michael Tierney stated: “He apologises for his actions. He is a 51-year-old man who should quite frankly know better. Whenever he committed this offence, bar road traffic matters, he had been out of trouble since 1995.
“I think the presentence report nails it when it says it appears Mr Dynes is a man who acts on impulse without thought for the consequences of the actions for himself or others.”
He added: “There had been a family situation where he had taken matters into his own hands. He shouldn’t have done it and he is very remorseful for it.”
Noting the plea of guilty, District Judge Bernie Kelly ordered the defendant to complete a combination order, consisting of 12 months probation and 80 hours community service.
In addition, Dynes was given 16 weeks to discharge compensation of £1,000 to the injured party.
