A Lurgan man who spat in the face of two police officers has been ordered to complete 180 hours of community service.
Addressing the 28-year-old, the district judge commented: “During Covid times, you of all people, given your mother’s health and your own health issues, should know of the fear of contracting the condition.”
Colin Hobbs, of Maple Court, appeared for sentencing on two counts of assault on police at Craigavon Magistrates’ Court on Friday.
Prosecution outlined that April 13, at 12.30am, police were called to a domestic disturbance at an address on Maple Court in Lurgan, during which they had reason to arrest the defendant.
Hobbs became aggressive towards police, shouting phrases such as “f****** b*******” and continued despite being warned.
The defendant then spat at one officer, hitting hit on the left side of his head. Hobbs was brought to the ground in a controlled manner where he proceeded to spit at another officer, striking him on the forehead.
During interview at Lurgan Custody Suite, the defendant made no comment to questions put.
District Judge Bernie Kelly commented: “In the report he claimed to have been alcohol free since the date of the incident. That would be impressive if it were true.”
Speaking from the court, Hobbs confirmed this to be the case.
Defence barrister Conor Lunny stated: “His behaviour towards his mother was disruptive rather than violent, but she should not have had to call the police.
“This was a guilty plea at the first opportunity…his genuine remorse comes through in the presentence report and it has been some six and a half to seven years since his last offence.”
District Judge Kelly said:” I do take into account the gap in his offending…it is also a positive, although granted it is self reported, that he has been alcohol free since the date of the incident.
“However, during covid times, you of all people given your mother’s health and your own health issues, should know of the fear of contracting the condition.”
Hobbs was sentenced to a total of 180 hours of community service for the assaults of police.
