A man who claims to have little recollection of assaulting police due to his consumption of alcohol has been sentenced to two years probation.
The 41-year-old’s barrister told court: “This is a theme in the report and in his record, which almost entirely relates to when he has consumed excess alcohol.”
Edvinas Vaitekunas, of Demesna Avenue in Lurgan, appeared for sentencing on assault on police and resisting police at Craigavon Magistrates’ Court on Friday.
Prosecution outlined that on December 6, at 7.30pm, police were called to a disturbance in Dingwell Park, Lurgan.
Upon arrival, officers observed the defendant who was aggressive and holding his arms out with clenched fists.
Vaitekunas charged towards the police and grabbed one officer by the wrist pulling them towards him.
A friend of the defendant came and tried to pull him away. Vaitekunas had to be taken to the ground by police and restrained.
Defence barrister Patrick Taylor stated: “Perhaps the most noteworthy part of the report is the offence analysis. He has very limited recollection of the incident.
“This is a theme in the report and in his record, which almost entirely relates to when he has consumed excess alcohol.”
He continued: “This is aggravated by the fact it was on an officer who was only there to help. He has no other matters pending but he has a number of convictions for violent offences.
“He is estranged from his three children. One positive is that he is in full time employment.”
District Judge Rosie Watters said: “He has served quite a few custodial sentences up to now. His record is pretty bad but probation could help him address his problems with alcohol and I would suggest anger management.”
Vaitekunas was sentenced to two years probation.
