A Lurgan man who had to assisted by police who found him lying on the ground with his genitals exposed has been fined £200.
Court heard that the 54-year-old, who could not remember the incident, was abusive to the officers who came to his aid calling them “free state b*******” and telling them to “f*** off”.
Charles Junior MacCabe, of Manor Drive, pleaded guilty to indecent behaviour and disorderly behaviour at Craigavon Magistrates’ on Wednesday.
It was heard that on August 5, at around 10.50pm, police observed the defendant lying on the footpath on Main Street, Waringstown.
MacCabe was wearing no trousers or shoes and his genitals were on show.
Officers had to assist the defendant in getting to his feet, they noted that MacCabe appeared intoxicated with glazed eyes, slurred speech and a strong smell of alcohol.
The defendant was not able to stand without the assistance of the police.
He became abusive towards the officers calling them “free state b*******” and telling them to “f*** off”.
MacCabe was warned about his behaviour on three occasions but continued and he was subsequently cautioned for the offences before the court.
Deputy District Judge Brian Archer commented: “The police were there to assist him, he is lucky not to be facing the more serious charge of exposure.”
Defence solicitor Pat Vernon stated: “He had been drinking for a long period of the day, he had gone back to a friends house where he believes his drink was spiked.
“He has no memory of the incident, he cannot remember being brought back to his friend’s house by police.”
He added: “This man does have a record but it is of some vintage”.
MacCabe was ordered to pay a fine of £200, along with the offender’s levy of £15, within 16 weeks.
