A Portadown man who threatened to cut his mother’s throat after an argument about money has been sentenced to nine months in prison.
Court heard that the 23-year-old had received three suspended sentences for similar type offending between December 2020 and April, of this year.
Kyle Elliott, of Clendinning Way, pleaded guilty to threats to kill, common assault, criminal damage, assault on police, two counts of resisting police and breach of a restraining order at Craigavon Magistrates’ on Friday, via videolink from Maghaberry.
Prosecution outlined that on June 5, at 8.12pm, police received a report of a domestic incident at an address on Clendinning Way, Portadown.
The injured party stated that she had arrived home from work at 7.50pm and her son, the defendant, had asked for a cigarette which she gave him.
She said that she could see he was in a bad mood as he slammed his phone on a table saying: “I have been stuck in this f****** house all day”.
The injured party stated her son had become nasty and an argument began regarding money. As she sat in a chair he came behind her and threatened to cut her throat.
Whilst his mother was in her bedroom, Elliott stood at the top of the stairs demanding money.
When she told him that she could not do it anymore, the defendant proceeded to bang his head on a door and threatened to cut his mother “into pieces”.
The injured party locked her bedroom and her son left the property taking another cigarette. She informed police that she had a restraining order preventing Elliott from demanding money off her.
Upon arrival, the defendant was located outside the property; although initially compliant he later lashed out and resisted officers.
Elliott damaged a central console of a police car and spat on the back of the driver seat, before proceeding to attempt to bite an officer.
Defence barrister David McKeown stated that his client had “severe difficulties” in his relationship with his mother and that in times away from her Elliott had behaved “impeccably”.
He stated that the issues lay when he returned to the “stresses of family life” and much of his record was due to similar examples of “appalling behaviour towards his mother”.
District Judge Bernie Kelly noted that Elliott was in breach of three suspended sentences, issued between December 2020 and April, of this year.
For the offences before the court the defendant was sentenced to five months in prison, a further four months of his suspended sentences were invoked, making a total of nine months in custody.
