A man who caused a collision whilst conducting a U-turn in which another vehicle was left on its side has been handed nine penalty points.
In sentencing the 39-year-old, the deputy district judge stated: “It would appear that the accident resulted in minor injuries but the circumstance were pretty frightening.”
Karim Dlimi, of Moygashel Park, had a plea of guilty entered to driving without due care and attention at Armagh Magistrates’ Court on Tuesday.
Prosecution outlined that at 12.30pm on December 20, 2019, police received a report of a two vehicle road traffic collision on the Moy Road, Armagh.
Officers spoke to this defendant, who was the driver of a BMW, with three children on board.
It was established that Dlimi had made a U-turn and collided with an oncoming vehicle which had ended up on its side.
During interview, the defendant had stated his children had been “acting up” and he had decided to turn back home.
Dlimi told police he had waited to check the road was clear but having seen the second vehicle oncoming he had stopped.
Defence counsel stated having been faced with a half mile queue of traffic into Armagh and with his children getting “restless” his client had decided to go home.
He said: “Unfortunately in making the U-turn he was met by an oncoming car, there were minor injuries to the driver and he has admitted that this was totally his fault.”
Deputy District Judge Philip Mateer outlined the statement from the injured party who recalled hitting the passenger side of Dlimi’s car and “being flipped possibly more than once”.
He stated: “It would appear that the accident resulted in minor injuries but the circumstance were pretty frightening..the driving was of a very poor standard and he has history with a previous in 2014.
“However, I do understand that his licence is essential to his work.”
Dlimi was handed nine penalty points and was ordered to pay a fine of £400, along with the offender’s levy of £15.
