His defence said he has 'been in custody some four months now' and is not due to be sentenced until April 8

A man who has pleaded guilty to possessing, making and distributing indecent images of children is to make a bail application tomorrow (Thursday).

The 25-year-old’s barrister commented that his client had spent four months in custody on remand for offences which carry a maximum sentence of six months, provided these were not ordered to run consecutively.

Michal Myszor, of Cole Court in Newry, pleaded guilty to possession of an extreme pornographic image, making indecent photographs, distributing indecent photographs of children, three counts of possessing an indecent photograph and 15 counts of possession of a prohibited image of a child at the city’s Magistrates’ Court on Wednesday.

As the defendant appeared via videolink from Maghaberry, District Judge Mark McGarrity commented that this appeared a case for a pre-sentence report.

Defence barrister Kevin O’Hare stated: “There is one slight issue. He has been in custody some four months now. From reading the maximum sentence for these offences is six months, that is if they are not consecutive.

“I would ask the court to consider a bail application for Mr Myszor.”

Prosecution commented that this would not be possible today (Wednesday) as there was not a police officer who could deal with such an application present.

The case was adjourned until tomorrow (Thursday) March 12 for a bail application, with sentencing to take place on April 8.
